DATA CONTROLLER
The Data Controller for the website www.eticasgr.it is Etica Sgr S.p.A., with head offices in Via NapoTorriani, 29 – 20124 Milan, (hereinafter “Etica Sgr”).

SCOPE OF DATA PROCESSING
The personal data of identified or identifiable natural persons who browse this website may be processed.

Navigation data

The computing systems and software procedures which run this website gather, in the normal course of their operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected in order to be associated with identified persons, but by its nature could, through the processing and association with data held by third parties, permit identification of the user. Within this data category are the IP addresses or the domain names of the computer used to connect to the site, the full Uniform Resource Identifiers of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric ID indicating the status of the server response (success, error, etc.) and other details on the user’s operating system and IT environment. This data is only used to gather anonymous statistical information on website use and ensure that it is working correctly and is deleted immediately after processing. The data might be used to establish legal liability in cases of alleged computer crime targeting the site. With this one exception, currently data on web navigation is not stored for more than seven days. The site uses technical and session-specific cookies to ensure that it functions correctly. These cookies do not collect information about your browsing activity.

AddToAny (AddToAny LLC) Type three AddToAny is a service provided by AddToAny LLC which visualises a widget allowing the user to interact with social networks and external platforms and share the content of this application. The service can be configured to show widgets belonging to third parties, e.g. managers of the social networks which share interactions. In this case, the third party providing the widget is informed of any interaction and the usage data for the pages on which the widget appears. Google Analytics Type three The site uses Google Analytics, a tool that helps owners of web sites and apps understand how visitors interact with the content of their properties. A set of cookies can gather information and generate site usage statistics without Google personally identifying individual visitors. Google Maps Type three Google Maps is a map viewing service offered by Google Inc. that allows the application to integrate map content on a website page. Google uses these cookies to remember users’ preferences and data whenever they visit web pages containing Google Maps content. These cookies contain enough information to permit tracking. Google Adwords Type three Etica Sgr may also use the advertising and remarketing tool Google Adwords. This tool allows us to advertise the Etica Sgr website and publish personalized ads based on users’ visits to our site. Some website pages may therefore contain a “remarketing tag”. This tag allows us to read and configure the browser’s cookies to determine which type of ad to show, based on visitor data, such as the navigation route, pages effectively visited and actions taken. The remarketing lists created are stored in a database on Google servers which memorizes the IDs of all cookies associated with any list or interest category. This information can only be used to identify the browser. Google is not able to identify the user. ScoreCardResearch Type three This is used to anonymously track patterns of online user behaviour (i.e. without making it possible to identify the data subject). ScoreCardResearch tags are not able to identify the users who visit a web page. For example, ScoreCardResearch Beacon tags collect data such as timestamp, URL and the name of the web page. Furthermore, the data collected by ScoreCardResearch is only used in aggregate form. SoundCloud Type three The web site may contain audio tracks from the company’s official SoundCloud channel. Soundcloud is a content delivery service offered by SoundCloud Limited that allows the application to integrate content on a website page. The personal data collected is usage data. Taboola Type three Taboola uses cookies and other device identifiers to gather information on users of the service. Turbo Adv Type three This is an online advertising service provided by Turbo S.r.l. Turbo’s technology optimises online advertising so that only the ads most relevant to the user are shown. Turbo works with advertisers and third parties to deliver relevant advertising to users browsing the Internet. Turbo is a voluntary signatory to the European Interactive Digital Advertising Alliance (EDAA) to improve the transparency and control of behavioural advertising data. Data furnished optionally by the user

The optional, express and voluntary transmission of personal data by the user via registration / data collection forms on this site involves the subsequent acquisition of data from the sender in order to satisfy a particular service request. The data is progressively inserted or visualised on the web pages referring to the specific on demand service.

OPTIONAL DATA TRANSFER
Besides the above information on navigation data, users are free to provide personal data in application forms or contact details when asking to receive news material or other communications. Failure to provide this information may make it impossible for us to deliver the requested service.

LOCATION OF DATA PROCESSING
Data processing connected with this site’s web services is performed on Etica Sgr servers.

Where necessary, the data may be handled by the company responsible for site maintenance, Mercury GP Srl, appointed Data Processor under the terms of article 28 of Regulation EU 2016/679.

LINKS TO OTHER WEB SITES
This site may contain links or access references to other web sites. The company has no control over the tracking technologies of other web sites to which this policy does not apply.

CONSERVATION TIME
Your personal data is processed using automated tools strictly for the time necessary to pursue the purposes for which it was collected. Personal data gathered for the purposes of statistical analysis are anonymised.

RIGHTS OF THE DATA SUBJECT
You are entitled, at any moment, to obtain confirmation of the existence or otherwise of your data, learn its content and origin, check its accuracy or request to extend, update or correct it (articles 15 to 22 of Regulation EU 2016/679). Pursuant to articles 15 et seq. of Regulation EU 2016/679 you are entitled to request its deletion, transformation in anonymous form or the blocking of data processed in violation of the law, and object to its processing even for lawful reasons.

AMENDMENTS TO THIS PRIVACY POLICY
Etica Sgr periodically reviews its privacy and security policies and, if necessary, amends them in relation to regulatory, organisational or technological changes. Where policies are amended, new versions will be published on this page.

STATEMENT PURSUANT TO ARTICLE 13 Regulation (EU) 2016/679 (General Data Protection Regulation), hereinafter the “Regulation”.

As Data Controller Etica Sgr S.p.A. is required to provide information regarding its use of personal data.

The personal data you provide during registration is processed for the purposes of handling your subscription and sending you the newsletter. Data provided for this purpose is essential to deliver the service requested.

This same data may also be processed, with your express consent under the terms of article 6 of the Regulation, for the following purposes:

a) mailing of commercial information regarding Etica Sgr products and services;
b) direct offers or market analysis regarding Etica Sgr products and services.

The provision of data for the purposes described at points a) and b) is voluntary. Your personal data will be processed by the controller either manually or electronically, for reasons strictly connected with the final purpose using procedures and instruments designed to guarantee maximum security and confidentiality in compliance with prevailing legislation.

Your data will only be disseminated or communicated to third parties specifically charged with performing activities essential to the purposes foreseen. These third parties may be companies responsible for the management or maintenance of the company IT systems or companies, including those resident outside the EU such as MailChimp, which are nevertheless signatories to the EU-US Privacy Shield Program which guarantees personal data security at each stage of processing.

You may exercise your rights under articles 15 to 22 of Regulation EU 2016/679 at any time including the data subject’s right of access, right to rectification, right to erasure, right to the restriction of processing, notification obligation regarding rectification or erasure of personal data or restriction of processing, right to data portability, right to object, and the right to automated individual decision-making, including profiling.

PURPOSES AND SCOPE OF DATA PROCESSING

DATA CONTROLLER

LOCATION OF DATA PROCESSING
Data processing connected with this site’s web services is performed at the premises of the provider by technical personnel specifically appointed to process the data, or for occasional maintenance operations.

DATA PROCESSING PROCEDURES
Your personal data is processed, sometimes using automated tools, strictly for the time necessary to pursue the purposes for which it was collected. Specific security measures are taken to prevent loss, illicit or improper use of data or unauthorised access to it. Etica Sgr S.p.A. has adopted all minimum security measures prescribed by law and based on the main international standards. It has also adopted further security measures to minimise the risks relating to the privacy, availability and integrity of the personal data collected and processed.

SHARING, COMMUNICATION AND DISSEMINATION OF DATA
The data collected may be transferred or communicated to third parties to carry out activities strictly connected to, and necessary for, delivering the service, such as managing the IT system. Personal data provided by users who request information (brochures, news material, etc.) is used exclusively to deliver the service requested and is communicated to third parties only when necessary (providers of mailing, labelling, dispatch services, etc). Besides these cases, personal data is not disclosed or linked to anyone, without the prior contractual permission or authorisation of the data subject. Thus personal data may only be transmitted to third parties in the following cases: a) with express consent to the sharing of the data with third parties; b) it is necessary to share the information with third parties in order to deliver the service requested; c) it is necessary to comply with a request from the judicial authorities or the forces of law and order. No data deriving from a web service is disseminated.

ACCESS VIA EXTERNAL IT SYSTEMS
Should you access your Private Area via an IT service requiring a login, where the Data Controller is not Etica Sgr S.p.A., this service will provide Etica Sgr with the personal data necessary to access the service requested (name, surname and tax number).

CONSERVATION OF PERSONAL DATA
Personal data will be stored in complete form for the entire period of execution of the contract. Subsequently, the data will be stored for a period of ten years in fulfilment of the obligations of the law and, in particular, article 2214 of the Civil Code. All or part of the data may be stored for a longer period in order to exercise or defend our rights in certain circumstances and, in particular, in a court of law.

RIGHTS OF THE DATA SUBJECT
We inform of your personal data protection rights under articles 15 to 22 of Regulation (EU) 2016/679:

  1. Right to access the following information:
    1. The purposes of the processing;
    2. The categories of personal data concerned;
    3. The recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
    4. The existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data or to object to such processing;

    1. Correction of inaccurate personal data without undue delay;
    2. Completion of incomplete personal data, including by means of providing a supplementary statement:
  3. Right to the deletion of personal data without undue delay, where:
    1. The data is no longer needed for the purposes for which it was collected or otherwise processed
    2. Consent is withdrawn and there is no other legal ground for the processing
    3. The data subject objects to the processing and there are no overriding legitimate grounds for the processing
    4. The personal data was unlawfully processed
    5. The personal data must be erased to comply with a legal obligation
    6. The personal data was collected in relation to the offer of information society services
  4. Right to the restriction of processing, where:
    1. The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
    2. The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of its use instead;
    3. The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
    4. The data subject objects to processing by virtue of the right to object.
  5. The data subject is entitled to receive notification regarding rectification or erasure of personal data or restriction of processing;
  6. The right to receive the personal data in a structured, commonly used and machine-readable format and the right to transmit that data to another controller, where:
    1. The processing is based on the express consent of the data subject for one or more purpose or by virtue of a contract signed with the data subject, and
    2. The processing is carried out by automated means;
  7. The right to object, on grounds relating to the particular situation, at any time to processing of personal data.

The data subject is entitled to make a complaint to the supervisory authority if they believe the rights specified here have not been respected.
